Definitions

The following words and expressions have the meanings respectively given to them:

“our”, “we”, “us”, “provider”, “Knight”, “Knight Hosting“, “Knight Hosting's“, refer to Knight Hosting Limited.

“service/s”, “provision”, refer to the services or equipment provided by Knight Hosting .

“user/s”, “customer/s”, “consumer/s”, “you”, “your”, refer to the person who has agreed to be bound by these Terms and Conditions of Service, or in the case of a person under 18 years of age, his or her legal parent, or guardian.

“Website”, refers to the Knight Hosting website www.knightHosting solutions.com

This Integrated Terms of Service (TOS) is the contract between Knight Hosting and the individual or entity to whom we have assigned a Client ID (hereafter referred to as Client, you or your), and governs the services as described on our website (Services). This TOS includes our Acceptable Use Policy (AUP), Privacy Policy and Service Level Agreement (SLA). It is very important that you read this TOS in its entirety; by requesting a Client ID, you consent to be bound by its terms. The effective date of this TOS is the date we assign you a Client ID (Effective Date).

We will not modify this TOS arbitrarily. However, because the ways in which the internet is used, and abused, evolve over time, we reserve the right to modify it. If we do, we will provide you with written notice sent to the email address you have provided us, and may post the notification on our home page. Unless a modification is necessary to respond to an emergency, we will give you seven days prior notice of any modification.

It is Client's obligation to ensure that the Services are used in compliance with these policies. Client is encouraged to include policies no less restrictive than our AUP and Privacy Policy in its contracts with its customers, or those who use the Services provided by us through you (collectively "End Users").

You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to you and your use of the Services.

1. General Information

1.1. These terms and conditions of service constitute the agreement between the user, or customer, and Knight Hosting . These terms and conditions of service also constitute the agreement between the user, or customer, and Knight Hosting , where a user or customer is renewing an agreement.

1.2. Knight Hosting and its users and customers shall be governed by the laws of England and Wales. Any actions will be under the exclusive jurisdiction of the English and Welsh courts.

1.3. Users and customers may also be subject to additional terms and conditions that may apply when using any third party services as part of the service offered by Knight Hosting.

1.4. Any failure of Knight Hosting to exercise or enforce any right or provision of the terms and conditions of service shall not constitute a waiver of such right or provision.

1.5. Knight Hosting reserves the right to alter or amend these terms and conditions at any time without notice. Any alteration or amendment will take effect with regard to the agreement made between an existing individual user, or customer, on the renewal date of that agreement.

1.6. Descriptions of the features, characteristics and limitations of the products and services we offer are set out on our website. We agree to provide the Services to you, as they are described on our website, as of the Effective Date, during the Term. Should these characteristics change after the Effective Date, we are not obligated to modify your Services to reflect these changes. If we do so, and you agree to purchase them, the Fee may change. We may make changes to these Services if a supplier makes components unavailable, cost prohibitive, if a beta period ends, or at any time effective on the end of the term of a particular Service.

1.7. We may decline to accept a request for Service if we determine that we require the facilities for other needs. Should operational needs require us to restrict or allocate Services among customers because of a shortage of facilities or causes beyond our control, we may do so without breaching this TOS.

1.8. Unless expressly set out during the Ordering process, the Services may be provided from any of our facilities. You will have no ownership right in the facilities, or in components of the Services. You will only have the right to use the Services.

1.9. The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority; ICANN in the case of .COM/NET/ORG and Nominet in the case of domain names ending with .UK, you shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name.

1.10. We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute. In registering a .UK domain you also agree to the Nominet TOS at http://www.nominet.org.uk/go/terms

1.11. We shall not release any domain to another provider unless full payment for that domain has been received by us. All charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our web site and shall be due and payable in advance of our service provision.

1.12. Invoices will be generated and sent to the client 14 days before the due date. Invoices will be emailed to the client and also displayed in the clients user area of the Knight website. Reminders will be sent closer to the due date.

2. Registration and Account Use

2.1. Users shall register on the Website by completing all of the required registration boxes.

2.2. Users shall provide full, complete, accurate and truthful information on registration.

2.3. Customers under the age of 18 must obtain the express permission of their legal parent, or guardian after informing such person that they will be subject to these terms and conditions of service, prior to agreement.

2.4. Knight Hosting is concerned about the well being of children using our services. Parents have responsibility in their decision to allow access to the internet and our services and to ensure adequate supervision at all times. Whilst Knight Hosting will do everything possible to ensure that unsuitable material is not accessible through the services we provide, it is the responsibility of the parent, or guardian, to determine whether the use of the service is appropriate for your child.

2.5. It will be understood by Knight Hosting that the parent, or guardian, of any customer under the age of 18 will be legally liable in any matters arising out of a user breach of any of these terms and conditions of service.

2.6. The user shall update Knight Hosting with any change in registration information within seven days of the change.

2.7. You must provide Knight Hosting with all information, access, and full good faith cooperation, including, if required, with your third party vendors, reasonably necessary to enable Knight Hosting to deliver the Services. We will rely on the information you provide to us. It is your obligation to keep this information up-to-date. We have no liability if communications are delayed, or not delivered, because of your failure to keep this information up-to-date. You agree that we may provide you with information that may negatively affect you by email. Please ensure that the email address you provide to us is configured in a way so that information from us is not rejected or marked as SPAM.

2.8. If Knight Hosting considers that any information supplied by the user in clause 2.2 or 2.6 is false, or misleading, or the user has failed to comply with clause 2.3, where applicable, Knight Hosting reserves the right to terminate all services to the user without notice or refund.

2.9. The user shall keep any password, or any other privileged code or information, relating to the user or services supplied, confidential.

2.10. The individual or entity set out in our records is the only entity authorized to access the Services. It is your responsibility to secure passwords and other access methods used to access the Services. If you administer an account on behalf of another party, you warrant that you will administer that account in good faith, and indemnify us against all losses and liabilities incurred by us should you administer the account in ways that are adverse to your customer and which result in a claim against us.

2.11. All orders are subject to fraud and security checks and we may request additional information and/or proof of identity.

2.12. Any add-on domains added to a clients email account are the sole responsibility of the client and not that of Knight Hosting.

3. General Service

3.1. The minimum period of service is one month for any of our services, unless otherwise agreed to in writing by an authorised official of Knight Hosting. If an order for a period of greater than one month is accepted, the minimum period of service is for that period of service ordered. No notice of non-renewal is required from the user, excepting in the case of co-located equipment, where twenty eight days’ notice prior to the renewal date are required unless otherwise stated.

3.2. All payment for services becomes due on ordering, or on renewal date of an original order. If a user wishes to renew an order the minimum renewal period is the period of the original order. If payment for renewal is not received by the renewal date Knight Hosting reserves the right to discontinue the service without notice.

3.3. Knight Hosting reserves the right to refuse, or postpone, any order for any reason at its discretion.

3.4. Where a new order is placed and Knight Hosting is unable to complete the order the customer will be contacted by email and provided with the reason for any action taken under clause 4.5. Postponement of a new order may happen due to technical difficulties resulting in insufficient space on suitable hardware.

3.5. Where an order is refused a full refund of any payment will be made to the customer within a maxi mum of seven days of the order but usually much sooner.

3.6. Where an order is postponed the customer will be entitled to a full refund. When contacted the customer may elect to receive a full refund within seven days, amend the order if practicable, or wait for the original order to be available. The decision of the customer, in this case, will be binding.

3.7. The setup of a new order will begin within 24 hours of receipt of cleared funds, unless the order is subject to action at clause 5.5. Where an order has been postponed and the customer has elected to change the order, or wait, the setup will take place as soon as practicable, in which case the customer will be informed of the setup date.

3.8. Any renewal of an order that has been subject to suspension of service due to a breach of acceptable use, will be at the discretion of Knight Hosting. Knight Hosting reserves the right to refuse such renewals.

3.9. If you resell the Service, or incorporate the Service into your own services, you are responsible for determining whether the Service will be appropriate for your customers (End Users) and for ensuring that they do not engage in any activity which would cause you to breach this TOS. Your End Users are not a third party beneficiary to this TOS, and you agree to indemnify us for any claims made against us by your End Users of any nature. Unless expressly set out during the Ordering process, we have no obligation to provide support to End Users. If we cease providing the Service to you, for any reason, you are solely responsible for securing replacement services for your End Users.

3.10. It is your obligation to back up your data. If the Services include backup services, these are provided as a supplement to your own backup efforts. Because no backup method is failsafe, we make no warranties regarding the thoroughness of our backup solution. If your data is restored from backup, it will be restored in the manner it is stored by us. This may not include formatting and other elements necessary to make the restored data available on the internet, or in the form originally transmitted to us. We are not obligated to restore the data in that format.

4. Colocation and Dedicated Servers

4.1. You have the right to use the Services covered by this section of the TOS (4.) to connect to our network, on a 24 x 7 basis, limited by this TOS. You will have no physical access to the equipment used to provide the Services.

4.2. The services covered by this section of our TOS (4.) are provided to you on a standard basis. They are not customized for your use. In some cases, they may have the manufacturer's default settings. This means that aspects of your website, or use of them, may not function without additional configuration by you. You bear ultimate responsibility to ensure that the Services are configured to meet your operational, privacy and security needs. Your site, and any other items you deem necessary to use the Services, must be compatible with them. Unless set out during the ordering process, we are not obligated to modify the Services to accommodate your use.

4.3. Our dedicated servers and colocation services have a set bandwidth allocation applicable to each service as set out during the ordering process. If in any calendar month you obtain any bandwidth or disk space usage over that basic allocation, then we will charge you its standard overage fee.

4.4. For dedicated Services your site will be the only site operating on our equipment. This equipment is leased, and not sold to you. You will have no ownership interest in this equipment.

4.5. Any equipment received for colocation will be inspected by our team and minor adjustments made to its configuration in order to operate on our network.

4.5. We provide remote facilities such as remote power functions and remote installation services as an addition to your dedicated server or colocated equipment and do not guarantee these services. The remote functions and installation services are used at your own risk.

4.6. Knight Hosting reserves the right to carry out the following tasks without notice, that may, or may not, interrupt service; routine maintenance, emergency repairs or maintenance, re-location of user services to alternative hardware where applicable, change of IP addresses.

4.7. Knight Hosting will always give a minimum of 24 hours notice for a period of routine maintenance. We will provide an estimate of the duration of the maintenance window, but this will be an estimate and the routine maintenance time may fall outside this estimated duration.

4.8. Knight Hosting will attempt to provide the service to the user without interruption wherever practicable. We will respond to any support tickets raised within 24 hours and where there has been an interruption in service we will inform the user of the reason where we are able to establish the reason. We will raise any issues that are concerned with the level of service by our Internet Service Provider (ISP) with that provider within 24 hours. If service is interrupted due to our fault, or the fault of our ISP, for 24 hours or longer, we will extend the period of service to cover the period of interruption for each day, or part thereof.

4.9. We will not interrupt the service for longer than 24 hours in any calendar month for routine maintenance. We will attempt to schedule such service in periods that we judge to be of light use. Any period that we inter rupt the service in excess of 48 hours in any calendar month will be deemed emergency maintenance and the extension of the service as in clause 4.6 will apply.

4.10. Knight Hosting is not responsible for any interruption of service that falls outside clauses 4.6 or 4.7. This includes external illegal “attacks” on the system or systems, whereby the system or systems need to be shut down for their own protection. In such cases we may decide to offer extensions of service, but this is entirely at the discretion of Knight Hosting.

4.11. Knight Hosting will not be responsible for saving or backing up any data related to user files or operation. This is the sole responsibility of the user.

4.12. Knight Hosting will be responsible for providing support for issues that are directly related to the services offered. Any support outside these services is at the discretion of Knight Hosting. Knight Hosting is not liable for services outside our control and has no obligation to provide support in this respect.

4.13. Knight Hosting shall have no liability to the client for any loss arising from any material, data or instructions supplied whether digitally or otherwise by the client or on its behalf which is incomplete, inaccurate, illegible, out of sequence or in the wrong form or arising from late arrival or non-arrival or any other fault by the client or on its behalf. No action, claim or demand arising out of or in connection with the contract or this agreement may be brought by the client against UK Dedicated Servers Limited more than one year after the cause of action has occurred.

4.14. Knight Hosting is not responsible for any delay, malfunction, non-performance and/or other degradation of performance of any of the services, hardware or software caused by or resulting from any alteration, modification and/or amendments due to changes and specifications requested or implemented by the client whether or not beyond those already supplied.

5. Free Domain Conditions

5.1. A free domain name will be registered for you with any hosting package for any period of time. The free domain must be added at the same time as ordering your package. It cannot be added later.

5.2. Only one domain will be registered free of charge per account.

5.3. Minimum hosting term of 3 months, after which you will be free to transfer the domain to another host should you wish. The domain also may not be transferred to another client during this time.

5.4. Clients cancelling packages to hop between promotion codes will have their promo codes removed and pricing reset.

5.5. If you cancel your hosting before the 3 month paid period Knight Hosting reserve the right to cancel or resell your domain.

6. Shared and Reseller Hosting

6.1. Any attempt to undermine or cause harm to a server or customer of Knight Hosting is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund.

6.2. All web hosting services are provided through the popular control panel cPanel.

6.3. Resellers may use their website for personal use or to sell to their own clients. Resellers cannot host free accounts under any circumstances.

6.4. We will transfer up to 25 accounts free of charge. Each account thereafter is charged at £1 each.

6.5. End user support requests are dealt with in the order they are received, we make no guarantees for the response time on end user support tickets however we aim to respond within 24 hours.

6.6. Free video tutorials are only valid for the length of your stay with us. If you cancel your package or the service is terminated the tutorials will cease to function.

7. Affiliates

7.1. Affiliates may not mask, hide or modify the affiliate link. It must be used as displayed in the client area.

7.2. You may not spam or advertise in areas or sections of websites that breach the rules of the displaying site. Doing so will result in the link being reported.

7.3. Payouts:

  • Shared and Reseller are a recurring 10%

7.4. The affiliate system may not be used to receive a discount on packages ordered for yourself. Any credit or earnings we deem to be suspicious will be removed without warning and not re-added.

8. Grounds for Suspension and Termination

You agree to comply with these Terms and Policies. Any violation of either, these Terms and Policies or the other rules, regulations or policies noted above may serve as cause for Knight Hosting to suspend or terminate your account. You agree that Knight Hosting has the right, with or without notice, to suspend or terminate your account upon the first or subsequent occurrence of any of the following

8.1. Using the Service in a way, which constitutes violation of any applicable statute, law, court order, tariff, regulation, or treaty (including, but not limited to, intellectual property, communications, privacy, criminal and international law)

8.2. Accounts on shared servers may send up to 350 emails per hour. If a single cPanel account exceeds this limit the account may be automatically suspended.

8.3. Hosting websites dedicated to pornography. Legal adult content is allowed however it cannot be the main focus of your website.

8.4. Using the Service in a manner intended to abuse or violate the privacy or property rights of others, including but not limited to sending of unsolicited bulk e-mail ("spamming"); this ground for suspension or termination is separate from and in addition to the fees which will result from such activity. You agree to pay a clean up fee of £30 per hour if any of our server IP addresses appear on a blacklist as a result of spam from your account.

8.5. Using your Hosting as a file or image Hosting service.

8.6. Using the Service in an attempt to break security, or so as to actually break security of any computer network (including the Service itself), or to access an account, message, or file which does not belong to you.

8.7. Using your account as a backup service. All files must be part of your website and must be linked to from your account. Dedicated server clients are exempt from this.

8.8. Using the Service in such a way as to forge or mis-represent headers, addresses, or other identification in electronic mail or websites, or using any other method to disguise the sender's identity or location. This includes the Hosting of Proxy Server applications.

8.9. Uploading, linking to or storing warez, cracks or other pirated software.

8.10. Hosting IRCD, image Hosting sites, autosurf, autocomment, autolike, port scanners, banner-ad services, escrow, banking, investment, lottery, gambling and pharmacy sites.

8.11. Assisting in or directly distributing copyrighted material.

8.12. Excessively using the Service in such a way as to limit the bandwidth available to others.

8.13. Providing fake or incomplete contact details, including name, postal address and telephone number.

8.14. Using the Service to operate server programs, including, but not limited to mail servers, IRC servers, game servers, ftp servers, Web servers, or streaming audio/video servers.

8.15. Using the Service for unauthorised relays through any third party systems.

8.16. Attempting, in any way, to interfere with or deny service to any user or any host on the Internet.

8.16. Performing a chargeback on any transactions past or present will result in account suspension until resolved. If a chargeback is issued we reserve the right to remove your account, impose a £50 fine per chargeback and deny any future business.

8.17. Using the Service for mail bombing, which includes any instance where multiple messages are sent to a specific destination with the intent to render the recipient and/or the electronic system serving that recipient dysfunctional.

8.18. Using the Service to add or attempt to add addresses to any mailing list (yours or a third party's) without the explicit positive consent of the addressee(s).

8.19. Attempting to cancel, supersede, or otherwise interfere with email other than your own.

8.20. Engaging in harassment, whether through language, frequency, or size of messages, either with email or website content.

8.21. Using the Service to engage in syn flood attacks, which are defined as overburdening a recipient computer system by sending a high volume of spurious data which effective impedes or totally disables functionality of the recipient system(s), or any other methods of denial-of-service attacks.

8.22. Furnishing false data on your sign-up form, contract, or online application, including providing fraudulent credit card or other payment information.

8.23. No bill credit will be given for a period of suspension. In the event of termination of your use of the Service under this section, Knight Hosting may at its sole discretion retain any or all amounts you have paid for use of the Service as liquidated damages for your actions.

8.24. Security - You agree not to access or attempt to access private areas of the Service. You agree to notify Knight Hosting as soon as you become aware of an unauthorized use of your account and/or any breach or attempted breach of security on the Service.

8.25. Intellectual Property - Knight Hosting does not undertake to examine or review messages, files, or other materials, which are accessible through, pass through, or reside on the Service. Complaints regarding alleged copyright infringement can be sent to abuse@knighthostingsolutions.com

8.26. Continuing a specific identification of the allegedly infringing material and the location(s) on Knight Hosting's facilities where the materials are to be found. Upon receipt of such written notice, Knight Hosting will expeditiously remove or block access to the allegedly infringing material, and provide notice to the person who had posted that material. If Knight Hosting receives a notification from that person indicating that the claim of infringement was based upon mistake or misidentification, Knight Hosting will send you a copy of that notification. Unless you notify Knight Hosting of appropriate court action to restrain the alleged infringement, the challenged material will then be restored or otherwise made accessible again.

8.27. Liability - You agree that use of the Service is at your own risk. Except for information, products, or services clearly identified as being supplied by Knight Hosting, neither Knight Hosting nor any of its affiliate controls, provides, operates, or is in any way responsible for any information, products, or services accessible through the Service. Knight Hosting neither endorses nor is responsible for the accuracy of third-party material(s), and you agree that Knight Hosting is not responsible for any loss or damage caused by your use of, or reliance on, such material(s). You understand and agree that you have sole responsibility for your posting of any information or material to any site or newsgroup on the Internet, including but not limited to postings to Web sites, whether residing on Knight Hosting equipment or not, postings to newsgroups, and participation in any on-line chat sessions. You agree to indemnify and hold harmless Knight Hosting and its employees, and other customers and subscribers from and against any claims, losses, costs, liability, damages or expenses arising out of your postings.

8.28. You agree that, should you use the Service to send or receive voice communications, Knight Hosting is not acting as a telecommunications carrier or telephone company, that there is no representation made by Knight Hosting as to the suitability of the Service for such use, and that all risk of connection, transmission quality, and accuracy of communications is solely on you, and that Knight Hosting has no liability of any sort for the failure or lack of quality of such use of the Service.

8.29. You agree to be liable for any damages or loss of service which results in damages to Knight Hosting as a result of any spamming or other violations of Section 5 above. These damages include, but are not limited to, system shut downs, retaliatory attacks or data flooding, and loss of peering arrangements. You agree that Knight Hosting may pursue any such claims against you in Court.

8.30. You agree that in no event will Knight Hosting have financial liability to you.

8.31. Services that exceed the invoice due date by 45 days will be terminated and any backups or related data shall be destroyed.

8.32. Knight Hosting will not tolerate any form of harassment against its employees from customers or third parties and we reserve the right to cancel a contract without refund in the event of unreasonable or inappropriate conduct. This includes threatening behaviour and abuse directed towards our employees thereafter any further communication must be via postal mail only.

9. Resource Usage

9.1. User may not:

  • Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
  • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run any bit torrent application, tracker, or client.
  • Participate in any file-sharing/peer-to-peer activities
  • Run any gaming servers such as counter-strike, half-life, battlefield1492, etc
  • Run cron entries with intervals of less than 15 minutes
  • Own more than 50% of a servers total domain names.

9.2 You may create your own backup of your account from your control panel however these may only be stored for up to 7 days. Please download archives to a local source and remove them from your account.

11. Free Charity Hosting

11.1. Free charity hosting packages will only be provided to registered charities with an active charity registration number.

11.2. Domain names are not offered as part of the charity hosting package and must be paid for unless otherwise agreed writing.

10. Warranties, Limitation of Liability and Indemnification

10.1. You warrant and represent that you own, or have the right to use, any and all data, software and hardware the transmission or use of which is facilitated by the Services.

10.2. We warrant that we own, or have been given a license by a third party to provide, the Services. OTHER THAN THE WARRANTIES SET OUT IN THIS TOS, WE PROVIDE NO OTHER EXPRESS OR IMPLIED WARRANTIES. EXCEPT AS SET OUT IN THIS TOS, THE SERVICES ARE PROVIDED AS-IS AND AS AVAILABLE. IN ADDITION, WE DISCLAIM ANY IMPLIED REPRESENTATIONS, WARRANTIES OR CONDITIONS, INCLUDING WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, TITLE OR NON-INFRINGEMENT. EACH OF THESE DISCLAIMERS APPLIES UNLESS PROHIBITED BY LAW.

10.3. TO THE EXTENT PERMITTED BY APPLICABLE LAW, AND REGARDLESS OF THE BASIS FOR A CLAIM, NEITHER PARTY, ITS AFFILIATES, OR SUPPLIERS, WILL BE LIABLE FOR ANY INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES, DAMAGES FOR LOST PROFITS OR REVENUES, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS INFORMATION) WHICH ARISE IN CONNECTION WITH THIS TOS AND/OR ANY AGREEMENTS INCORPORATED BY REFERENCE. THIS PARAGRAPH APPLIES EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES, OR THAT SUCH DAMAGES WERE FORESEEABLE. THIS LIMITATION DOES NOT APPLY TO A VIOLATION OF THE AUP OR A PARTY'S INDEMNIFICATION OBLIGATION.

11. Confidentiality

11.1. Confidential Information is non-public information, know-how and trade secrets in any form that are designated by the parties as confidential, or which a reasonable business person knows, or reasonably should understand, to be confidential. The following items are within the definition of Confidential Information without needing to be designated as such: this TOS; any information placed by Client on the Services, as limited by the Privacy Policy (Client Data); and Knight Hosting's network configuration.

11.2. The following items are outside the definition of Confidential Information: information that is, or is made, publicly available without a breach of this paragraph; was known by a party without a legal obligation to keep it confidential; is independently developed by a party without reference to the Confidential Information; is a comment or suggestion Client volunteers to improve Knight Hosting's products or services.

11.3. Subject to this paragraph, the parties agree not to disclose the Confidential Information to third parties, other than as necessary to provide the Services, and then only for the purposes set out in this TOS. The parties agree to take reasonable steps to ensure the security and confidentiality of the Confidential Information, steps at least as protective as those used to protect their own Confidential Information. One party shall notify the other in writing within twenty four hours of its discovery of disclosure of the Confidential Information, and cooperate with the other to regain control and prevent further dissemination of the Confidential Information.

11.4. Either party may disclose the other's Confidential Information to affiliates, or if required to comply with a court order or other government demand that has the force of law. However, the party subject to the court order agrees to give the other party notice within a reasonable period of time to allow the owner of the Confidential Information to protest it, unless notice is prohibited.

11.5. The obligations of this Section shall remain in effect for three years after termination of this agreement.

11.6. You agree that Knight Hosting may check your personal information against security and fraud databases and reserve the right to deny you any service based on these findings.

12. Governing Law

12.1. These Terms and Policies are governed in all respects under English and Welsh laws.

13. Discount Vouchers

  • Only one voucher can be used per transaction.
  • If the order value is lower than the value of the voucher, the remaining amount is lost.
  • Discount vouchers are restricted to one per customer.
  • Vouchers can be redeemed against the purchase of any Shared, Reseller, Dedicated or Colocation service.
  • Black Friday discount codes do not include a free domain name when used.

14. Cancellation Procedure

14.1. Cancellation requests must be submitted through the client area. To do this, click the icon next to the package you wish to cancel then press 'Request Cancellation'. You must then complete and submit the form.

14.2. Choosing an immediate cancellation means your service will be terminated with 24 hours of submitting the form.

14.3. It is your responsibility to ensure any paypal subscriptions you have setup are cancelled.

14.4. No other forms of cancellation are accepted.

15. Privacy

Knight Hosting will not provide names, addresses, telephone numbers, email addresses, or other personally identifiable information on any Subscriber to any third party without prior permission from that Subscriber, or as required under an appropriate court or administrative directive, including a facially valid subpoena, or as necessary to render the Service. Knight Hosting may provide aggregate data on Subscribers to third parties in the operation of Knight Hosting's business.
